A Barrie Police Service officer did not act unlawfully during an incident in August in which a man was injured, according to the province’s Special Investigations Unit (SIU).

The officer responded to a business in the evening of Aug. 30 after receiving a report of a man who had been threatening customers and staff.

A 40-year-old suspect was located nearby and, after a brief conversation, the officer attempted to arrest him for public intoxication.

“As they walked to the officer’s cruiser, the man kicked the officer in the knee and the officer forced him to the ground. The man’s face struck the pavement in the fall, resulting in facial fractures,” the SIU stated in a news release.

“SIU director Joseph Martino determined there were no reasonable grounds to believe the man’s injuries were attributable to any unlawful conduct on the part of the officer. There was no basis for proceeding with criminal charges in this case and the file has been closed.”
