Midland resident accused of impaired driving in Penetanguishene

The driver was also charged with not complying with COVID-19 emergency orders

PENETANGUISHENE - An officer on patrol from the Southern Georgian Bay detachment of the Ontario Provincial Police (OPP) conducted a vehicle check for a possible impaired driver at 12:22 a.m. Jan. 28, 2021 in the parking lot of the Penetanguishene Mall. The officer made the check after observing the drivers abilities while heading north bound on Simcoe County Road 93 into Penetanguishene.

The officer after speaking with the driver and a female passenger entered into a drinking and driving investigation and a further search of the involved vehicle resulted in a seizure of a bottle of partially consumed liquor and a quantity of marijuana.

The driver was transported to the OPP detachment for further investigation and as a result, the vehicle driver Matthew Greg Trott, 40 years of Midland, has been charged with the following offences:

  • Operation while impaired - blood alcohol concentration (80 plus)
  • Operation while prohibited under the Criminal Code

Contrary to the Criminal Code of Canada:

  • Driving motor vehicle with open container of liquor

Contrary to the Liquor Licence Act:

  • Drive - hand-held communication device

Contrary to the Ontario Highway Traffic Act:

  • Individual - fail to comply with an order made during a declared emergency

Contrary to the Emergency Management and Civil Protection Act.

The accused was released from police custody on a undertaking to appear before the Ontario Court of Justice in Midland on Feb. 11, 2021.

The involved vehicle was towed and impounded for 45 days and the accused's driver's licence has been further suspended for 90 days under the conditions of the Administrative Drivers Licence Suspension (ADLS) .

The 20 year old female passenger of Midland was also charged with - Individual - fail to comply with an order made during a declared emergency contrary to the Emergency Management and Civil Protection Act.
